Good to know
Signing a financial lease for your business? Have the contract checked before you sign. When you lease for your business you are not a consumer: there is no fourteen-day cooling-off period and the consumer credit rules do not apply (articles 7:57 and 7:66 of the Dutch Civil Code). If you fall behind, the general conditions usually allow the lessor to end the lease, take back the car or equipment and claim all remaining instalments with interest and collection costs, less what the asset sells for. Courts generally hold businesses to those terms (Midden-Nederland District Court, 22 July 2026, ECLI:NL:RBMNE:2026:5081).
Already facing a claim as a sole trader? What counts is what the lease was really for, not the trade name on the contract, so have the claim checked before you pay or agree to a payment plan.
